Sub: Request for grant of Grade Pay of Rs 5400/- to the ASPs after completion of 4 years of regular service in G.P. of Rs. 4800/- earned under MACP Scheme

Respected Madam,

Association wishes to bring to your kind notice following provisions requiring in-depth analysis, favouring for grant of GP of Rs. 5400/- to those entire ASPs cadre officials, after immediate completion of their regular service in GP of Rs.4800/- earned under MACP. It is hoped that these would certainly find in line and would be taken into consideration before arriving at a just and favourable decision.

It is brought to your kind notice that as per Government of India’s Resolution No. M.F No. 1/1/2008-1C, Dt. 29.08.2008,clause (x) (e), “Group-B officers of Departments of Posts, Revenue, etc. will be granted Grade Pay of Rs, 5,400/- in PB-2 on non –functional basis after 4 years of regular service in the grade pay of Rs,4,800/- in PB-2”. As per this clause all the group “B” officers of Department of post, Revenue etc will be granted grade pay of Rs. 5,400/- in PB- 2 on non functional basis after 4 years of regular service in the grade pay of the 4800 in PB-2.

Further, as per Para 9 of the Annexure I to DoPT O.M. dated 19.05.2009 issued from F.No. 35034/3/2008-Estt.(D): Regular Service for the purpose of the MACPS shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption / re-employment basis…...past continuous regular service in another Government Department in a post carrying same grade pay prior to regular appointment in a new Department, without a break, shall also be counted towards qualifying regular service for the purpose of MACPS….’’.

As per Para 2 of DoP&T OM No 5034/3/2008-Estt(D)(Vol.II) dated 01.11.2010: “….financial upgradation under the MACPS shall be allowed in the immediate next higher grade pay in the hierarchy of revised pay bands as given in SSC (Revised Pay) Rules, 2008”.

The 1st schedule of CCS(RP) Rules, 2008 as mentioned in Rule 3 & 4 above, pay band & grade pay on the pay scale as applicable for every post/grade shall be specified. Para 7.6.14 of the report of Pay commission would make it clear that a Group“B” officer in PB-2 with a Grade pay of Rs. 4800/- will get the Grade Pay of Rs. 5400/- after completing 4 years of regular service on non – functional basis. The enhancement of grade pay is not dependent on the post, but on regular service of 4 years in Grade Pay of Rs. 4,800/- in PB-2 (Rs.7,500- 12000 pre-revised).

As is evident from DOP&T letter No. 10/02/2011.E.III/A dated 7-1.2013 the pay of Govt. Employees on promotion to a post carrying higher duties and responsibility but carrying the same grade pay is to be fixed by way of addition of one increment of 3% of the sum of pay band of the existing grade pay. As such on assuming higher responsibility from the date of promotion of ASPs to Group “B” no financial benefit is given. Apparently the GP of Rs.4800/- earned by ASPs by virtue of length of service after 30 years is treated as final GP for all purpose. Had this not be the position the pay of ASP on assuming higher responsibility must be fixed under FR 22 1(a) 1. As such claim for grant of Grade Pay of Rs, 5,400/- in PB-2 from the date of financial upgradation in GP of Rs.4800/- on non – functional basis vehemently uphold.

However, Grade Pay of 5400/- is not being granted to the ASP who got 3rdFinancial Upgradation under MACP Scheme and completed 4 years regular service in Grade Pay of 4800/- on the pretext that non-functional up-gradation to the Grade Pay of Rs 5400 in the PB-2 can be given on completion of 4 years of regular service in Grade Pay of Rs 4800/- in PB-2 (pre-revised pay scale of Rs 7500-12000) after regular promotion and not on account of financial up-gradation due to MACP. On the other hand no pay on so called regular promotion is fixed under FR 22 1(a) 1.

 In this context, it is pertinent to mention here that as per GOI resolution 1/1/2008 IC dated 29.8.08 does not make a categorization within Group B cadres viz ASP/ Supdt. in Departments of Post for the purpose of grant of Grade Pay of Rs 5400/- as both cadre are in Group B and enjoying gazetted status. In terms of MACP scheme notified by the DoPT vide OM No 35034/1/97- Estt(D) dated 9.8.1999, the financial up-gradation under the scheme should be granted to the pay scale of the next hierarchical cadre.

It is not out of place to mention here that on plain reading of DOP&T memorandum No. 10/02/2011.E.III/A dated 7.1.2013 leads to the conclusion that either pay of the officer on assuming higher responsibility should be fixed under FR 22 1(a) 1 in the same GP treating regular service on promotion in the relevant GP or financial upgradation under MACP or otherwise should be considered a regular service in that GP. Two separate interpretations on one issue are bad in the eyes of law and are consideredmischievous, farfetched, hyper technical and illegal.

In the light of above submissions, it is most humbly prayed that Non Functional Grade Pay of 5400/- may please be granted to all the IP/ASP/PS Group B officers effective from the date they have completed 4 years regular service in Grade Pay of 4800/-.

                   Time has come to get up early. The Circle Office Guwahati had take some homicidal decision  for promotion/transfer etc. which has adversely affect the day to day life of our members. Inspite of my request the Chief PMG Assam Circle did not take any decision for consideration of Ad hoc promotion  for PS Group B cadre. Again some of our ASPs are transferred to different station  at any time twice/thrice in a year.
To stop this practice this association wants to show our anger in shape of pendown/ wearing of black badge etc . The Circle Secretary wants the consent from each and every members. It is hope that your consent will reach before CS on or before 20-3-2013.

The Circle Conference of this association has badly delayed with hope that Jorhat branch will host the same. But it has not come to light. It is therefore requesated any division except Sivasagar to host the same. The ASP  (HQ) of each Division will take decision and will intimate to the CS  within  20-3-2013. If no division has come forward to host the Circle Conference, the same will be held at GUWAHATI in the month of April 2013.

Budget 2013: Tax amendments you can expect in rent allowance, LTA & gift tax

The government has been trying to make the tax laws simpler every year; however, there are numerous amendments required in the tax laws. The union budget for the FY 2013-14 will be presented before the Parliament on 28th February 2013 and the finance minister has promised many reforms expected to combat inflation along with stable tax rates.

There may also be some changes in the tax slabs to provide some relief from the ever-growing inflation. Here are a handful of the number of amendments expected and predicted by analysts in the Union Budget for 2013-2014.

Rent Allowance :

All those people who do not have their own house and stay in a rented accommodation or employees who do not get accommodation or house rent allowance from their employer enjoy a special tax deduction on the rent paid by them. This deduction is allowed under section 80GG of the Income Tax Act in which an individual can avail 25% deduction on the rent amount. However, the limit is restricted to Rs 2000 per month and has not changed for many years, which is now expected to change this year.

Moreover, under the Income Tax Act 1961, there exist 2 dissimilar sets of tax treatments with reference to rent free lodging provided by the employer. While a Government employee only pays the license fee, non government sector employees who get rent-free lodging from their employees are taxed heavily at 7.5-15% of the salary. There is a necessity to maintain uniformity in taxes and a new system needs to be introduced offering equal rights to employees without discrimination.

Standard exemption should continue as in the past and should be given to all employees who are salaried, while the transport allowance deduction should increase.
Capital Gain Scheme : 

To save capital gain, an individual can invest in capital gain bonds according to section 54EC of the Income Tax Act. The upper investment limit under this section is Rs. 50 lakh. In the past, there was no such cap and all transactions related to property were done with white money. With the government making changes to this law few years ago and placing a limit, people have been resorting to unwanted ways to save tax. This cap, hence, is expected to be removed in the forthcoming budget.

Prime Minister's Appeal to Central Trade Unions (STRIKE ON FEBRUARY 20 & 21)

I appeal to the Central Trade Unions to withdraw their call for a countrywide General Strike on 20 and 21 February, 2013. Such a strike would lead to avoidable loss to our economy and inconvenience to the public through disruption of services. While some of the issues raised by the Trade Unions are already being acted upon and others are at various stages of consideration, I have requested my senior Cabinet colleagues Shri A K Antony, Shri Sharad Pawar, Shri P Chidambaram and Shri Mallikarjun Kharge to together hold discussions with the leaders of the Trade Unions. I am confident that these discussions would result in a course of action that is acceptable both to the Trade Unions and the Government.

MNC submits memorandums to PM, Union Finance Minister

National Mazdoor Conference (NMC) submitted the memorandums of demands to Prime Minister Dr. Manmohan Singh, UPA Chairperson Ms Sonia Gandhi and Finance Minister Sri P Chidamabaram in New Delhi.

Demands projecting by NMC Chief Subash Shastri in the memorandums including constitution of 7th pay commission, immediate merger of 50 percent DA into basic pay/pension, grant of 20 percent interim relief to the salaried class across the country till the implementation of the recommendations new pay commission, raising income tax exemption limit to Rs five lakh, and enhancing the monthly wages of daily rated workers to Rs ten thousand.

In the memorandums Shastri stressed Union Finance Minister to raise the income Tax exemption limit From Rs two Lakh to Rs 5 Lakh and total exemption of DA from income tax limit, the salaried class feel that this gesture will increase purchasing power and stimulate demands.

Other demands emphasized in the memorandums mentioned included granting B-1 status to Jammu and Srinagar cities.

Shastri said that the demands highlighted in the memorandums would be major issue during the forthcoming election of Lok Sabha as these pertain to crore of Central and state government, employees and pensioners and their families which constitute a large chunk of voters.
